    Default Maryland Domestic Violence-2nd Degree Assault

    I have been charged with 2nd Degree assault. I have no prior arrests. My wife and I had a bad fight. We have been married for 15 years. I slapped her at one point and she called he police. We both came to our senses but the process had began. The police came, I admitted what I had done. Because of the mark on her check I had to be arrested. The police treated me fairly and said that they had no choice because of the laws of Maryland. So now I have a court date coming up soon. My wife doesn't want it to go to trial but the state is charging me not her. She was told to call about a week before the trail and talk with the DA and they can give her a better idea of their intentions as far as the trail. So for me I'm kind of in limbo. I feel that because of the circumstances I should hold off on a lawyer because the case may be settled without a trial, maybe? But if there is a way not be convicted and not have a record I don't want to miss out on it.
    If I go to court without a lawyer can I argue my case if necessary without hurting myself by things I might say?

    If you're being charged under § 3-203 - Assault in the second degree, you could be looking at TEN YEARS behind bars if convicted (plus fines). There is police documentation of injury - so the prosecution has more than the typical "he said she said" case - thus they have little incentive to bargain. You need a criminal defense attorney like YESTERDAY. Every word that comes out of your mouth to anyone OTHER than your attorney can hurt you.
