    Default Suing In Small Claims

    Hey new to the site but I just wanted to know do anyone think I will win or loss this case:

    I bought a engine part for my car from a seller online about 5 weeks ago and I told the guy on the phone and by email I need it before my school spring break he agreed to have it done. But every week up unto my spring break he gave me lots of reasons he want be done so spring break past still have not finish more and more reason why he's not done.
    So to shorten this I file a thing called paypal claim report against him to put a hold on his account for what he done.
    So he sent me emails saying if I do not drop the claim he will send me anything long as he provide tracking information and paypal will never know. So he sent 3 different threating emails like that.
    Eventhough we came to an agreement that if I drop the cames he will send the item out on time but he didn't once I drop the claims.
    I call him no answer and do not reply to emails anymore.
    So I filed a small claims against him saying that he did not do his part of the deal and I just want my money back.
    (I have emails and invoice of all the stuff he said and the agreement we had)
    So should I win with my proof?
    Also do anyone know what kind of form they will send him in the mail saying that I'm sueing him?

    Laws and court procedures are different in each state. The viability of your small claims case will be better if you and the seller are in the same state.

    I'm in GA and he is in CT so I guess thats why he did this then.
    So do it seem like I will lose because I have to go to his state for this?

    You may win a default judgment, but you would still have to collect it. And he can object to the judgment if you try to register it for enforcement in Connecticut.

    I guess I don't need to tell you this, but you shouldn't have dropped your PayPal claims.

    I was going to say the same thing. Never should have dropped the PP claim.
