    Default Colorado Eviction Threats

    I have a month to month lease and have always payed the rent on time and been a good tennant. My landlord is an old cenial drunk.
    All of the rental units are falling apart; poor insulation, leaky roofs, sparking outlets, mold, mice, broken windows, leaky propane pipes etc. One unit does not have a working refridgerator nor hot water and there is no way that this place is up to code. He won't fix anything.
    One afternoon my landlord drunkenly accused me of some wrongdoing that a worker on the property did. I politely tried to explain that it was not my doing and he began to violently curse at me while I just stood there occasionally saying yes or no and that I was not trying to cause any trouble. He told me that I have to get my things and leave.
    Does this mean that he can "evict" me for no apparent reason? Do I have to leave or do I have 3 days from the time I get official papers?
    I am afraid to confront him again since he has frightened my girlfriend and is known locally as very hot tempered. In the past there have been rumors of him evicting people at gun point, which I have personally heard him refer to, to some extent.
    At this time I do not have the means to move and it is still winter up in the mountains.
    What can I do? Does anyone know of a good lawyer in Colorado that has dealt with this sort of thing?

    Thanks Happy, that clears up some details
    In regards to peaceful possession of property and "peaceful possession",
    we are afraid of the landlord and he violently curses and is unpredictable due to his drinking. He has snow plowed my car in on more than one occasion which has caused me to miss or be late to work.
    The door knob/lock no longer works, which he will not replace and now all we have is a little pad lock. He once cut the lock to "check" some pipes....nothing was changed, fixed or altered, and he left the premises unlocked for 2 days while we were gone.
    These issues do not seem right to me and are/ have affected my personal and professional life.
    It is not my fault that he is disliked by the community and has a serious drinking problem...
    He evicts roughly 25% of his tennants and has been sued multiple times.

    Yeah, he sounds like a genuine nut job.

    If it were me I would be avoiding him, looking for another place, and giving notice to get the heck out of there.

    I am supposed to give 10 days notice, which means that I would be liable for next months rent. If I get him on video or audio telling me to leave, and giving me my deposit back, would that hold up in court if he tried to sue me for rent?

    I doubt he will give you permission to tape him. In Colorado you have to have consent from all parties, doing so otherwise could result in a felony charge.

    You state he wants you out of there too. If you can catch him (sober) and get him to sign something agreeing that it is alright for you to leave early, then that is what I would try and do.

    Wow, a felony charge!! Good thing I didn't tape him!
    But what if he is threatening me, locking me out or comming to my door yielding a gun. I could not tape that and get him in trouble for it?
    Otherwise what kind of proof would I have, beside one mans word against anothers.
    If he is doing something illegal towards me why could I not tape it, call the cops and show them the video and go from there? hmm

    I believe you would be safe if you recorded him as long as the audio was turned off. You could also take pictures.

    However, it would be advisable for you to check with your local law enforcement or better yet, an attorney in your state.
