Default My Boss Lied To Me About a Bonus Gift

I started working at [a company] located in Los Angeles back in January. When I started, my new boss promised me to give me one of the product, a bidet in this case. The rest of employee just got one for Christmas.

It was an old model the company no longer sold nor was brand new, but I was happy to get one.

For the last 3 month he kept saying I had to wait little longer whenever I asked about it. Finally I have had waiting and asked him whether I'd get one or not. Then he said I haven't shown my patience enough, so he decided not to give one.

I was appauled and upset. Isn't this a breach of verbal contract?

Unless there was an actual contract, such as "in exchange for working for me I will give you a bidet", or where it was implied as part of your compensation for taking the job, my opinion would be no. A promise isn't an enforceable contract, as there is no consideration from you to obtain it. You don't suffer any additional detriment, as you would be required to work as part of your employment anyway.

Google up contract law, elements of contract, theory of consideration, etc if you'd like to learn more.

Thank you so much for the reply. There was no contract but everyone at work knows he promised me and mentioned him at least once that he should have given me what he promised whenever the subject was brought up.

I will not back down and post his lies and his porno viewing habit during work hours on popular sites on the internet with his real name and position as well notify as his lack of qualification and the job performance to the company CEO.

Will there be any legal backfire to do so?

I do not own any property nor have significant assets to lose.

Do you ever plan on ever having any assets? I'd give your plan a second thought.

You have a current job to lose and potential future jobs to lose. Your ideas for retribution should be flushed down the nearest bidet.

While the CEO may be unaware of your boss' internet viewing habits, do you actually think he doesn't know the performance of his company or your boss and doesn't know your boss' qualifications? How much weight do you think he is going to give to the opinion of a three month employee who is mad because s/he didn't get a freebie?

I suggest that you accept his decision not to give you the bidet and hope you are still employed when the next Christmas bonus is handed out.

    Are you NUTS?

How much money do you have to spend on legal fees? If it's not in at least five figures, drop the whole idea. You might want to think about how you're going to pay that lawyer without a job when you get fired, too.
