    Default H1 Transfer After Being Laid Off

    Hi,

    I worked for Company A for 6 months and then I got a better offer so I moved to company B who transferred my H1 to them. I've been working for them since 6 months and now I feel that the company B may cut some jobs.

    I'm sure company A through whom I came to US has not canceled my Visa yet, if I'm laid off by company B

    1) Am I still eligible to transfer my Visa to any company given that Company A has not canceled my visa yet?
    2) Am I still in status given that Company A has not canceled my Visa?


    Any assistance is highly appreciated.

    You don't need to "transfer" back to Company A, unless they have revoked your I-140 as it relates to them; I doubt that they have.

    You're only in status if your working.
