We purchased a property in Florida in 2006 ( warranty deed). It was vacant. After pulling all permits from our county and HOA we could start constructing our home. Soon after installing a silt fence our neighbor started complaining that our construction site is in on his property-about 17'. We showed him our most recent survey showing that we are within safe distance from property line. He kept complaining to us and HOA on numerous occasions. He was advised to check with the county. Later on, our surveyor advised him to have a survey done by other certified surveyor. Our neighbor called our surveyor to complain about their crew surveying and staking out our property. He even took one of the stakes out a few times. Now our HOA stepped in ordered us to stop construction until we and our neighbor can produce surveys that are in agreement with each other. Here is the problem: our neighbor hasn't showed us any recent surveys of his properly so far. He truly believes that his is right. He has time and nothing to lose. We have a construction loan with interest ticking. And we have to pay the bank if there is no progress in our project. Questions: Can HOA say that have no authority in such disputes and then change their mind? Can they stop me from building despite the fact that they approved our site plan? Do I have to sue our neighbor to make him update his survey?
