    Default Dilapidated Easement Ditch Flooding My Yard

    I live in Biloxi, MS. There is a drainage ditch that runs behind my house (N - S) and another that runs alongside my properrty line (E - W).

    After Katrina, the woods behind my house laid down. The ditch that runs E/W has an 300 + yr. old uprooted oak whose roots are about 15 ft tall. This is clogging up that ditch. I contacted my area representative and the city issued a work order (this was in aug of 06). By Feb 07,still no action. I literally had to draw an arrow with red spray paint on the road to show them where the ditch SHOULD be, before they would admit it's existence!

    In March 07, I noticed some county workers out back cleaning out the N/S ditch. I went out and asked if they were going to work on the E/W ditch as well. They said no, but they would see what they could do. When they got to the junction behind my house, they dug the trench about 20 ft INTO my yard. I ran out and showed them my fence under their machines and they said they would be back to fix it tomorrow. Haven't seen them since. This is directing the neighborhoods water into my yard!

    After a confrontation with the mayor at a town hall in May I was promised that he would take care of it personally (yeah, right) but it wasn't until July when I was on the news that they came out and started to redig the E/W ditch. Here's the kicker. The public works guy said the tree clogging it was not his problem and rather than removing the tree, they were going to marry the E/W ditch on the side where the county had dug the N/S into my yard. I told them that this was unaccepatable, yet th SOBS did it anyway!!! They dug down about 3/4 of the way down and stopped. Water will always find the lowest point so now between the city and the county, my home has literally been damned. My kids can not go out back because the ground has the consistancy of pudding and the snakes LOVE their new habitat.

    I cannot get any action from the city or the county. They are back to the "not mine" attitude they had in the beginning. What can I do? This is causing serious damage to my property!!!

    I am no expert but I would call and stop by the local television stations and see if they would come out to film this mess. Seems to me that is the only way things are going to happen. You may check your area for free legal service, there are some out there. I wish you well, makes my problems seem small/
