    Default Company Layoff

    I am in California. In August of 2007 the company I'm currently working at announced that my department was being moved to the Philippines. The company offered in writing a buy out if we stayed until the date we are given, along with a notice of last day of employment NO LATER than 60 days. My last day was set for July 1st, 2008. On March 22, 2008, I was given a new release date of April 1st, 2008, giving me a 40 days notice. My question is, do I have an argument to get paid through July 1st, 2008 and/or request to get paid for the additional 20 days that I did not receive notice for? Pls help.

    Unless you have a bona fide employment contract to the contrary, your employer does not have to pay you for any time not worked.

    You were given notice on 3-22 (today is 3-20); release date 4-1?
