    Default Harrassment At Work

    I am a Manager of a small business located in Florida, I recently demoted a supervisor under me due to not doing her job, lack of communication and some serious problems with her attitude towards staff and her supervisors, recently I found out that she filed an age and racial claim against me. She never went through the proper grievance process, and she bragged about it to all staff weeks before it was even brought to my attention by my superiors. Now she is walking around company untouchable because of this. My superiors are now looking at me for a scapegoat even though several managers has identified her negative behavior and racial attitude in evaluations before me. Whenever I have to talk to her or give instructions she writes a grievance on me again never following the policies. I really feel that my job is in jeopardy even though my job performance is superior. What can I do?

    "What is the proper grievance process for filing a claim?" With whom did the employee file a claim of age and race discrimination? Is it being investigated? How do you know that your "superiors are now looking at [you] for a scapegoat?" Is she the first employee who has filed a claim of discrimination? How did you employer respond to the others?

    you can go to the eeoc and file a discrimination charge.

    He has no standing to file a charge that EEOC will process. He has not alleged that his employer has discriminated against him on any protected basis. It is not discrimination for someone to file a charge alleging that he discriminated.

    OP - you might want to answer mitousmom's questions of 3-20. I agree with mitousmom that based on what is posted, there is no illegal discrimination.
