My 16-year-old daughter is dating a "rough around the edges" 17-year-old dropout whose mother has decided to take on the role as mother with my daughter. I recently found that they are having sex (which she is old enough to consent to), but that the boyfriend's mother is facilitating the act by buying the condoms and making sure her house is devoid of any people so they can have sex. The mother has been encouraging my daughter to do things she knows are against my rules (come home well after legal curfew, skip school to spend time with her son, encouraging them to get married and even said that she would sign for my daughter to do this--how? forging my name?-- and even took them to get the "engagement pictures" taken at a professional photographer in town). Last week I ended up having to call the police on my daughter as a CHINS. I found that was skipping school (5 days total) and had spent the day with her boyfriend at their family's apartment with the mother's knowledge and in the presence of his mother. While we were trying to "discuss" this matter, she kept throwing things in my face that the boyfriend's mother is telling her --one thing was that she is 16 and she can consent to anything she wants now, another was the boyfriend's mother saying she would serve me papers to adopt my daughter, and another was that the mother would help her file for emancipation, a word my daughter would not even know on her own. What took the cake after this incident was that I ended up taking my daughter's cell phone away from her as part of her punishment. The boyfriend's mom the next day went and got my daughter a phone on her cell plan and gave it to my daughter to have and hide from me so she could stay in contact with the boyfriend.

What I am wondering is this --I want to file a restraining order and contributing to the deliquency of a minor charges against the boyfriend's mom. I can find all kinds of information on protection orders in the State of South Dakota, but not really anything on restraining orders. Can I file for a restraining order and if so, where would I be able to find a form to facilitate this? Thank you in advance for any help!!
