    Default Can I Add My Fiance To My Daughter's Birth Certificate?

    Hi there, I live in Florida with my fiancé, my daughter from a prev. relationship, and by daughter with my fiancé. My oldest is 7 and does not know her bio dad. He has been in prison since I found out I was pregnant and has had no part of her life. My fiancé would like to adopt her but we fear a little reluctance from her bio dad. Since her bio dad has not signed her birth certificate is it possible for my fiancé to sign the birth certificate legally without going through the adoption process? My daughter only knows my fiancé as her father and I would like to keep it this way for her own protection. If we do go through with him signing the birth certificate and a name change can the bio dad dispute it? Thanks for any help you can give.

    Your fiance is a legal stranger to your daughter. Right now he isn't even a step-parent.

    The bio father could contest an adoption procedure or maybe he would be willing to give up his parental rights. However, right now Florida doesn't even recognize him as the legal father. (That would still need to be established.)

    Fiance can not just get his name added without the two of you making a sworn statement that he is the biological father or perhaps even a court order to do so, and as pointed out the prior would be fraud. You both know he is not the biological father.

    A step-parent adoption would be the legal way of handling this. There aren't any short cuts.

    OP, you and your fiance will need to be married for one year before you can begin a step-parent adoption.
