My daughter goes to a boarding school in New Mexico.
One day she returned to her room after an all school celebration and found that it had been gone through. All of her drawers were pulled out, her sheets were ripped off of the bed, some posters were torn from the walls, her clothes were pulled out of her closet, her guitar was out of its case, and 500 dollars was missing from the room. Right away she got a RA, and then an administrator, who then wrote up a report.
The next day, the police were called. This was the third time in the school's history that the police were called.
Later that day, two students came forward to say that they had gone through my daughter's room. They say that they used her roommate's key--with permission-- to get into the room, and then they admit to "going through" her belongings in order to "retrieve something that she should not have had."
They say they did not "trash" the room, but simply left evidence that they went through her things. They also say that they did not steal any money.
The boys were not punished.
My question is can I press charges against them for breaking and entering or trespassing, even if the school would rather 'push this issue under the rug'? If so, what type of lawyer do I get?
