My mother and I are taking care of my cousin's two toddlers because their mom is in poor health and my cousin is jobless. We have been for 2 months now. My cousin hasn't spent a dime, so we're getting aid from social services and WIC. He has signed the power of attorney and temporary guardianship over to my mom. Now he's talking about coming for the kids. Can he just take them back even though he's not working and his wife is so ill she needs 24 hr care? The pair have had a history of their kids taken away. Five/six years ago, their first son died in Foster Care. Will the social workers flag this case and say no to my cousin? Or can he get the kids back? Should we go to family court to hold him to his obligations as a parent? What are the legal ramifications here pro and con for all parties involved?
