    Default Injury When Working Off The Clock

    On the days that we are short-handed, we tend to get out late since there are fewer of us to do the closing (food service). We are told we must clock out on time--no overtime allowed--but that all the work must be done before leaving. We all work as fast as we can and still have 10-20 minutes of work left to do. There are a few of us who clock out and continue to work until finished. I refuse to do that! If we got injured at that time, we wouldn't get any compensation would we?
    [The Director knows the employees do this and says it's not allowed BUT there is a big grin and a wink when it is said.]

    This is a violation of the Fair Labor Standards Act. Contact your local Wage and Hour board and turn them in.

    If we got injured at that time, we wouldn't get any compensation would we?
    You are correct. It's up to you to prove that you were injured while performing your regular job duties. If you are injured while working off the clock, there is no record of you performing those duties, and it becomes your word against your employer's.

    Where would I find the number for the local Wage and Hour Board for Indiana?
