    Thanks for responding this is real good info. I'm not 100% sure if it applies completely to my situation. However, I will consult with an attorney to see if I have a case and if we can win this. I tried on my own and didn't get very far.

    My advice to people in similar situation is to get legal representation. It's not worth it for you to duke it out with your employer at the referee hearing on your own; especially with the stakes being high. By the way the source you provided is also good.
