    Default Marital Home In Texas

    I have a friend who is going through a divorce in Texas. Long story short, she is no longer welcome in her home because her husband has a new girlfriend. As of right now, no papers have been filed at all. She knows that she cannot afford the house payment, but since she had to completely move out before she had planned, she also does not have enough money to live on her own. My question is, what should she do about the home they shared? Both names are on the house. She doesn't want the house, but how can she make sure that she still gets something from the home that they purchased together?

    She will petition the court for an equitable division of the marital estate, including the marital home. She should consult a divorce lawyer.

    If she does not want to stay in the home will the husband have to buy her out? Or, if she chooses to sign her rights away, how can she guarantee that the bank will release her from any liability if he defaults on the payments? Will that happen if he refinances the mortgage in his name only?
