    Default Parole Violation

    My boyfriend was released in 1/07 to a program had to stay there something happened and he could no longer stay there cause he was afraid for his safety he told his p.o. what happened and they did nothing so he stopped reporting today they came looking for him for abscounding he has no other crimes and his parole would have been up 10/08 hes been running since may, I want him to turn hisself in but he thinks that if he stays out until 10/08 and then turns himself in he wont do anytime, is that true this is in nyc.

    If he turns himself in how much time can he get can they make him do more than what his max out time is since his parole was up in 10/08 and he ran in 5/08 so is that the amount of time they will have him do no other arrests or trouble just abscounding.

    He could serve out the time he was given for his original sentence.

    The absconding has its own penalties.

    It isn't going to go away, he should consult with an attorney and find out the best way to handle this.

    He needs to turn himself in. Running from this problem is not going to anything for him. He needs to consult with an attorney and then turn himself in.

    He will be facing new charges along with having to finish his original sentence.

    He's a fool for believing that he can outrun his sentence. The fact is the sentence will be placed on hold until he is found. Then it comes back with a vengence and he will have other penalities to pay for running.The longer he is gone, the longer he will be gone.

    I dont know about New York but in California Prisoners are allowed on parole on a program called ICDTP. In this program they are allowed out to society on limited amount of time along as they do their meetings (AA, NA, Prop 36, Anger management etc.) But they must be accountable for the amount of time their Parole Agent assigns them to that program. This means they must go back to the program after all there meetings failure to return to the program is violation of their parole which includes 5 months in prison. What your husband should of done was to write a complain (602) to the director explaining how he was in danger or whatever and his parole agent didnt do anything about it. So in case something did happen to him he had already notified them and they will be responsible for anything happening to him.
