Hi I am have a problem I am looking to solve. I co-signed a student loan for my mother's "husband" (now I know he is just a live-in deadbeat). He was supposed to finish his program, which he did, and according to our verbal agreement, he was to pay it off ASAP. After some pressuring from my mother I gave-in onthe premise they informed of any negative problems before they happened (to avoid a bad credit) (I knew about the risk, but still took it, fool me).
Anyways, 8 months later I get a call from the loan people, harrassing about paying (not 1 payment had been made), calling all the time. I learned that during this time (during which my mother informed me that all the payments were being done on time and a bunch of lies). Okay, I understood I was liable for loan, and I assumed it. I finally paid it off in January. The loan originally was for $8,000, but ended up paying about $6,000. I think this is not fair. In fact, given their attitudes towards me during that period, I believe I was downright scammed by my mother and him (meaning, they had no intention of paying from the beginning, but I am still confused about why did they thought this was such a great plan if they never touched the money as it went directly to the school). I am broken by the betrayal, but this is not a psych forum.
I am here because I have no idea how to proceed. I live in California, they live in Florida. She used to live in a home I owned, moved him in, stopped paying rent, and finally got them evicted (I got a gun pulled out on me in the process as well).
Needless to say, I want to feel the satisfaction of screwing someone legally over and over until I get every last cent that is entitled to me. If jail time could be something I could impose upon them as well, Ill go that route TOO. I know they have money because they are working, not paying rent (live with my grandma), bought a nice car, and some electronics, and I am sure some drugs and other crap.
Do I have any rights from here on? I know nothing about the legal system and while I could contact a lawyer, I dont know what kind should I get (bankruptcy?).
1. Can I sue for everything back? Including legal costs incurred by this? What about my time for having to pursue this?
2. What about placing charges (not necessarily, but it can sweeten my lovely bitter coffee)?
3. If I sue, what are the chances of getting the money back?
4. I want his truck.
LESSON: Never co-sign again. For ANYONE. My son will go to school on his own name and sweat.
