    Default Changing Move Out Notice Requirements In Texas

    After recently moving out of my apartment I recieved a notice saying I owed fees due to not giving a full 60 day notice. I went over my lease agreement and it states that only a 30 day written notice is necessary. I copied the lease agreement and sent it along with a letter to the management. I never recieved any notification or signed anything to acknowledge the changing of move out notice requirements. They sent back a letter dated almost a year ago that I have never seen before. Can they just change the move out requirements as they please without my signature? At no time in my 30 day notice did anyone attempt to contact me and let me know I would be charged for an early move.

    I have not read your lease. I know nothing about the letter. Apparently I'm supposed to guess that it supposedly requires 60 days notice?

    Did you move out at the end of your actual lease term, or did your tenancy go month-to-month after the end of your original lease term?

    If the former, a court should not uphold an attempt to unilaterally change the terms of your lease by sending you a letter. If it's the latter, it might be an effective modification of your month-to-month tenancy, but you can still sue them in small claims court and deny that they ever sent you the letter.

    The lease I signed was for a 30 day notice to move out. That lease expired some 2 years ago. Since then I've been going month to month.
