My friend and room mate was charged with domestic disorderly conduct on Friday night, which he did not commit. (In State of Wisconsin) Let me give you a little bit of background on his situation.
He dated this girl for almost five years, they seperated about two and a half years ago. They have a daughter together who is now three and a half. They have for the most part been very civil towards each other. The only problem they have had up until this point is going to mediation several times. In the initial mediation meeting they agreed upon several things, including where the school district the child would attend. The mediation agreement stated that if a party member moved from the designated school district that it was their responsibility to transport the child to where they needed to be. She moved a while after this was put into effect and has since tried to get it changed several times. The mediator has flat out told her that because both of them have clean records, and are good parents, no judge would grant her request just becuase she wanted it. This we believe is the basis of her accusations.
On Friday March 7, TJ (my friend) recieved a call from his ex (Rebecca) asking him if he could come pick Emily up from her apartment. They normally meet in public in the parking lot of TJ's employer. Rebecca said she was sick and couldn't drive. TJ agreed to pick up his daughter from her apartment and also agreed to pick up some things for her from the store. He had never been to her apartment before this, so had to get directions. He arrived at her apartment, talked to her for about a half and hour, got his child and left. Five hours later he was arrested at my house, which the cops wouldn't tell us what for at the time. I had to bail him out of jail on a charge of domestic disorderly conduct. Rebecca then requested a temporary restraining order be placed on TJ. She claims that while he was at the apartment, he twice tryed to pull her onto his lap, which she refused. Then she said he pinned her between the arm of the couch and himself and started kissing her neck and grabbing her breasts. She says she went into the kitchen where he again pinned her against the counter and continued kissing her neck. None of this happened. TJ is an outstanding man, and would never do anything to jeapordise his rights to his daughter. Rebecca claims that she was in immediate danger, yet did not immediately call the cops, or stop TJ from taking their daughter from the house. She also claims that she waited in the post office across the street for him to leave, when in all actuality she waived to TJ while he was pulling out of the drive way. The woman who was too sick to drive 10 miles, was not to sick to walk a block to the post office.
Also over the course of the past year or so she has made several innappropriate comments towards TJ aksing him if he considers her a MILF, and commenting that she was lonely and asking if he missed her. He's been rejecting her, so she's turned this whole thing around on him. Does anyone have any advice as to what he could do to prove she's lying. If he has documented text messages and phone calls, can he present those at his hearing? Thanks for all your help
