    Default Minor Shoplifting In Macys In New Jersey

    My 17 year old daughter was caught shoplifting last night at macy, the police were called and she was taken to the station and finger printed and release to her older sister, I spoke to the police officer last night and he said he is not absolutely sure what will happen and was given me all these scenarios but said we should receive something in the mail in appx. 2week and they said Macy can also demand addition money to be paid to them for the theft. They didn't issue a summons to her, just said she would recieve something in the mail. I am a little confused, if Macys send a demand for payment does that mean she will still have to go to court and is it macy who decides if they want to press charges or do the police now press charges against her. I know I should have ask all of this last night when I spoke to them but was totally very upset and mad that she would do suck a thing. Any advise you could give would greatly be appreicated.

    The Demand payment is called "Civil Demand" its legal and state law. Its a Civil action (hence the name Civil Demand) the amount will depend on the amount of items stolen. This seperate from any fines that will result from any conviction which is her "criminal case".

    Thanks for your response, do you know if it will be Macy's proceeding with filing of criminal charges and it is looks like it is most definiate since she was taken to the station and finger printed.

    The prosecutor, not the victim, is the one who decides whether to file charges.
