My grandfather just received a letter that he is being sued for an accident that happened in June 07. My grandfather, who has parkinsons as well as many other health issues, drove his golf cart across a 2 lane road (in front of his home) to get his mail. When driving back across, he did pull out without noticing a car coming a little too close. The car swurved to the left clipping his cart and hit the other driver coming in the other lane. My grandfather was hurt badly as well as the driver of the cars passangers-not the driver to my knowledge. They all were taken to the hospital for evaluation.
Since then, my grandfather had his license taken away do to his health and this accident.
Now, the diver of the car is suing my grandfather for pain & suffering along with mental anguish and want a certain amount of $ or they will take further actions.
The driver of the car and her passangers were heading back from a family reunion. The passangers were drunk, but not sure if they found alcohol in the drivers system or not.
The road also goes from 55mph to 40 just before my grandfathers farthest driveway. We are looking into if the driver of the car was speeding.
Either way, what is the general outcome for my grandfather? Shouldn't the suer go through his home or auto insurance company first? What if she was speeding, is there a suit?
