    Default Married Illegal Immigrant, With T.P.S

    I am in Michigan, I am married to an illegal immigrant who entered illegally. They are from El Salvador, and have "Temporary Protected Status" I have filled a I-130 petition for status change, which has been approved. The notification stated that they would contact the proper consulate for consular council. Will she have to leave the country for this. I am worried because we have three children together and do not want to split the family up.

    It should not be necessary, and would not be advisable, for her to leave the country. She is considered to be lawfully present in the United States as long as her TPS status continues.
