    Default Statutory Rape?

    My boyfriend and I have been together for 10 months. His birthday is today, 3/10, and mine is Wednesday, 3/12. Before today, he was 19, and I was 16, and my parents were perfectly fine with us being together. They loved him. I love him. Basically though, my mom found out that we had had sex the other day and she is not happy about it. She doesn't want us to see eachother anymore and she said that if he tries to talk to me she is going to press charges against him.

    What I want to know is how seriously can I take her and if she even has a legitimate case. I know that in Texas, which is where I live, if I'm 17 or older, then it's not considered statutory rape. But the problem is she found out two days before my 17th birthday. And also, he is 3 years and 2 days older then me. So, if anyone can offer me any information, it would be greatly appreciated. I don't think she would have much of a case but it helps to know, because if she does, I don't want to push my luck...

    It doesn't matter that you will be 17, it matters when the offense happened.

    Whether you love him or think you do wont matter. A crime was committd one that can land your adult BF in jail and face lifetime registration as sex offender making jobs very hard to get. The best thing you can do for him is end relationship until your 18

    Sexual assault for anyone to intentionally or knowingly penetrate a person under age 17, other than his spouse. The actor has an affirmative defense if he is not more than three years older than the victim, who is at least age 14
    Two to 20 years in prison
