    Default Writ Of Possession Expiration Date

    Back in December 07 on the morning of my Unlawful Detainer court date my Landlord called me to settle out of court. We agreed that he would make repairs and rid the unit of rats and cockroaches and I would pay the back rent. The owner called the management co. and told them to not send their lawyer to the court house. The lawyer showed up to court anyway and I lost due to default..(I should have seen that coming) A few days latter the money was paid by myself with a cashiers check and we both signed an agreement. The owner never made any repairs. And has now told me he never will, including fixing my heat. Here is my question...Since the judgment has been paid in full with full acknowledgment by the owner can the Writ of possession still be executed 3 months latter?

    At a minimum, the acceptance of rent following the termination of your prior tenancy creates a new periodic (month-to-month) tenancy. That's probably backed up by whatever "agreement" it is that you and your landlord signed.

    Why not handle things properly this time around?

    Thank you ... aside from common decency what is to keep him (the landlord) from using the Writ against me and having the sheriff serve me with a 5 day notice in the future? How can I clear the judgment with the court or at least show the debt has been paid?
