    Default Landlord Sued Me And Lied About The Date Of Service

    I'll Try To Keep This As Short As Possible, It All Occurred In San Diego County, Ca.
    A Family Member And I Rented The House, The Family Member Moved In First. Sewage Problems From The Start Of Occupancy. Landlord Initially Tried To Do The Right Thing Even Though He Was Stupid About Giving Plumbers His Credit Card Number Telling Them To Just "fix It". A Month Later I Moved In. Within About 5 Days The Whole Back Of The House Flooded (my Part). Called Ll (landlord) For Authorization To Call Flood Service, Got The Ok.

    Service Came, Ripped Out Doors, Moulding, Walls To About 18" Above The Floor. Ll Refused To Repair Any Of It Stating The Flood Was My Fault (his Own Plumber Said No Or Could Not Find A Cause For Toilet Overflow) Tried To Make My Renters Insurance Pay Which Of Course They Would Not And Further Stated That Of Course It Was Not My Fault.
    AFTER LIVING THIS WAY MORE THAN 2 MOS. CONSULted Attorney Who Said I Could Legally Withhold Rent Which I Put Into A Trust Acct. Was Taken To Court For Non-payment Of Rent....judge Did Not Make Him Do Anything As He Had Put Up Drywall 2 Days Before Court, Taped And Semi Sanded Only, No Paint. Took Off A Couple Of Days Rent For Me And That Was It.
    Family Member Couldnt Take It, Moved Out, Left Me Holding The Bag, Rent Was Late, Got Evicted In Court Even After Ll Hade Agreed To Take Rent W Late Fees Which I Had In Full, Had Made Extensive Repairs To The House Myself W/own $.
    After I MOVED OUT This !$@^%^%()__*^#%#!!!!! Person Sued Me And Then Lied About When He Served Me (can Be Proven That The Person He Stated He Served Was At Work That Day Almost 2 Hours Away) So That When I Went To Court To File An Answer He Had Already RECEIVED A Default As He Knew That The Last 2 Times He Filed On Me I Waited Till The Last Minute To Answer......HE NOW HAS A JUDGMENT AGAINST ME FOR A TOTAL OF ALMOST $20,000.00 FOR NOOTTHHING I HAVE DONE. AN ATTY SAID HE COULD PROBABLY WIN MY CASE BUT IT WOULD COST ME MORE THAN I CAN AFFORD WHICH IS WHAT THE LL IS COUNTING ON SINCE HE IS PART OF A LANDHOLDING CO. I HAVE NO LARGE AMOUNT OF REAL DEBT EXCEPT FOR THIS JUDGMENT AND AM ON EXTREMELY LIMITED FUNDS HAVING FOUGHT AN EX-HUSBAND FOR 2 YEARS WHO HAS DISREGARDED EVERY COURT ORDER GIVEN AND CONTINUES TO GET AWAY W/IT. I AM TRYING TO REPAIR MY LIFE HERE, SHOULD I JUST GO AHEAD AND FILE CHAPTER 7 ?? W/MY INCOME I CAN PROBABLY QUALIFY....I WOULD BE ABLE TO HANDLE ANY DEBT I HAVE BUT CANT AND WONT AFFORD TO PAY SOMEONE THAT HAS CHEATED AND ABUSED ME.....WHAT SHOULD I DO? I WANT TO BE ABLE TO BUY A HOUSE SOMEDAY....
