    Default How Do I Start The Emancipation Process In Louisiana

    I am currently the age of 15. I plan to try to Emancipate myself when I turn 16 on June 27th. I do plan on going to college, and am looking for a job as we speak to try and save money for the emancipation process, how much will this cost and how exactly do I go about it in Louisiana?

    How will I be sure I will be able to achieve my goal?
    I am an advanced student and very mature for my age, I should earn my diploma at the end of this summer through an online homeschool program, however my parents are reluctant to let me move on with my life.

    Realistically, unless you are supporting yourself, living on your own, etc you don't have much chance without your parent's approval until you are 18 years old.

    What exactly is motivating you to seek emancipation?

    The only way you can be certain you will achieve your goal is to turn 18. It is by no means certain that any teen will be granted emancipation, which is based not on want but on need. As someone else on this board put it recently, "My parents want to hold me back" is not a good reason for emancipation. "My parents were killed in a car crash and I have younger siblings to take care of" is.

    I've worked hard to be able to graduate two years early.
    I worked that hard to be able to leave as soon as possible because my household is a very hostile and peculiar environment.

    So having my diploma will not help the situation?

    As soon as I can find a job, I will start the process of trying to support myself, by means such as paying for my own tuition with my current schooling.

    Also, if I need to be living on my own, yet, can not move out because of my age unless I was to be emancipated, is it to far out of my reach?

    What else can I do to help my odds, or is it fundamentally not feasible?

    Are your parents willing to consent?

    You stated that your parents are reluctant to let you move on with your life. So I doubt they will approve of it.

    Emancipation is rare, and your parents will be allowed to speak as to why you should not be emancipated.

    My mother is willing to give consent, but my father is not.
    They may be legally separated by the time this does take place, they can not afford it at the moment.

    Additionally, i'd like to ask, if I was to move in with an adult that was not supporting me and I supported myself would that be the same as living on my own or would I have to be paying some sort of rent?

    I know that there is a lot of things that must be done before I can even begin to start to qualify which is way i'm taking action now, before I am sixteen.
    I'm just trying to find out all that needs to be done to increase my chances.

    How many months does the process take?
    I plan to start college in the upcoming spring semester.

    If this adult is a boyfriend, the chances of a judge emancipating you would be nil.

    Art. 3993. Hearing; judgment

    If the judge is satisfied that there is good reason for emancipation and that the minor is capable of managing his own affairs, he shall render a judgment of emancipation, which shall declare that the minor is fully emancipated and relieved of all the disabilities which attach to minority, with full power to perform all acts as fully as if he had reached the age of majority.
    You have a huge burden of proving you are capable of managing your own affairs. Right now you don't even have a job. You also will be a full-time college student.

    I don't think you understand how expensive it is to be self-supportive.

    How are you planning on paying for school?

    Emancipation can take several months, depending on how busy the family court is.

    I'm referring to relatives of a very close friend.

    The job I hope to acquire within the next two weeks, will of course be a minimum wage job, however, I am a home schooled student so I will be able to work a reasonable amount of hours at this job.

    Although, even with those hours, would it be enough?

    I do not fully understand how much it will cost, which is why I am researching and trying to map this all out.

    Fafsa requires your parents income information when you apply for federal grants, loans.....

    I'm glad to hear that you worked hard on your studies and plan to further your education. Going to school and working is going to be challenging.

    So, if I was emancipated, because I would be independent, I would get less money for school?

    I probably would be better off asking for permission, but only one of them would probably grant it to me.

    I guess I will just have to hope my mother will be able to afford a divorce soon, which she has just gotten a third job in hopes of trying to earn money for that reason.

    If they aren't together at the time, if I do decide to do this after researching more and doing everything else that comes attaches, would I still need both of their consent?
