    Question Pregnant But Divorce Is Not Final

    I live in the state of WI and am going thorough a divorce, we have been seperated for 6 months and during that time I started to see someone else. I am now pregnant with my boyfriend.

    I want to know if I will be able to have my boyfriend's name on the birth certificate or if the state will require that my soon to be ex-husband's name is listed. Also in Wisconsin the Judge needs to grant back your maiden name after the divorce is final and I do not want my married name on the certificate. Would you know if I would be able to use my maiden name on the birth certificate?

    Oh dear.

    If the divorce is not final when the child is born, your husband will have to be on the birth certificate.

    Similarly, you can't use your maiden name on the birth certificate until the judge gives it back.

    this situation is similiar to mine except I am the husband!
    My wife and I are still legally married but she is pregnant with another man's child
    are the laws any different in Florida?
    she will have had the baby before the divorce is finalised it as she is not cooperating at all.
    She left me and is pregnant by someone who she is no longer seeing.
    My worries are:
    1. can she put my name on the birth cert
    2. am I considered the legal father
    3. will i have to pay child support for somone other man's child
    4. I can easily prove that the child is not mine with a paternity test but how long will this take and will I have to pay child support until I prove this?

    Yes, because you will still be married she will be required by law to list you as the father.

    Yes, until paternity is disestablished in court, you will be the legal father.

    No, you won't have to pay CS as long as you have paternity disestablished BEFORE the divorce is final.

    The divorce might be delayed by a few months by having a DNA test done, but it will be more than worth it.
