    Default can grandparents claim nephew?

    My Mother in law has claimed my 15 month old son onher taxes this yera, I Had no idea and she has no idea that I know, the thing is she doesn't take care of my son at all.........never has taken care of him, because I am a stay at home mom. Can she do this? and does she need to obtain his social security number in order to claim him?

    please let me know, so i can deal with this accordingly, should I rat her out? or should i warn her for future?
    PS: we dont get along

    Default Claim of Dependency Deduction

    If more than one person claims a minor as a dependent, the IRS will audit the situation to find out who is entitled to the deduction. Only one deduction will be allowed. It is tracked by Social Security Number, so the IRS will likely deny the deduction or send a letter asking for the number if that was not provided by your mother-in-law.

    thank you.

    I haven't provided her with his tax #, but I know who has, without knowing what she wanted it for, ok so when my husband does his taxes, there shouldn't be a problem for us right? She had no right to do that did she?

    as his parents, you and your husband are entitled to claim the child before anyone else. Both returns will likely be audited, so I would suggest notifying the IRS of her "error" anonymously. They do not disclose the reason for an audit, so she need never know. I am sure they'll explain the tax laws to her at the time of the audit.

    On a side note, I beleive you can also get a reward for turning in a cheater, but I'm not positive about that part.
