    Default Roommate Not On Lease

    I recently had a roommate who lived with myself and my girlfriend. When we moved in to the Townhouse, he was not added to the lease. We had a verbal agreement that he would pay $200 per month for rent. However, we have lived in the townhouse for almost 8 months, and have only received rent twice. The roommate has also never paid any portion of the utilities since he moved in.

    With his name not being on the lease, what recourse do I have to recover the money that is owed? I live in Tennessee, and I'm not sure if Small Claims Court is the route I need to go, or is there a different route?

    Start by giving him a written notice that he has 30 days to get out.

    Then yes, take him to small claims.

    So what should I do if he has already moved out, but I still want to collect the money he owes?

    Skip the "get-the-hell-out" letter and proceed right to the "take him to small claims" part.
