    Default Wrong Expiration Date In Lease

    I am having a similar problem. I notice that the lease I signed said the the lease terminates on May 2007. It was supposed to be May 2008. It wouldn't really have been an issue but now it is. Back in November the landlord had suggested to us that if we wanted to move out early that we could. We live next to crazy neighbors and she had came over to my house and started yelling obscenities and so forth. This was happening quite frequently and the landlord knew of it because she used to live here and moved away because of it. At any point, I called the landlord after the incident because I was terrible upset and afraid to go out of my house. She said she that if we wanted to move we could and she would understand and if we are not happy she doesn't want us to stay here. After talking about it and a few more incidents happened, we told her when we gave her our January rent that we considered her offer to move and that we were going to start looking for a new place. She said fine and that by March she was putting the house back up to sell regardless if we had moved or not. I did find a place and told her in February that I would be moving on March 15th. I asked her how she wanted to handle March's rent. She told me that she would prorate the rent for March, but she was keeping all the deposit because I was abandoning the house. Well this is where it all begins. she said technically she could charge me for the full lease and keep my deposit, but she wouldn't do that. so she wants me to pay half of March and keep my whole deposit. I told her she couldn't do that, because she gave us permission to move early and in also the lease states it is expired so in default in would turn into a month to month. With a month to month you only have to give a ten day notice, which I gave a three week notice. On top of that, when I told her I put in an application, she immediately listed the house on Craigslist. I had not given her any notice yet that I was moving and the house was already up for rent. I got scared that if I wasn't accepted in this new place that I wouldn't have anywhere to live. Can anyone give advice on this matter? Do I need to get a lawyer. In Louisiana it also states that if you give the landlord the rent for a month to month then it reinstates the lease. I don't want to reinstate the lease for March but what about the 15 days I am still living here. Does she take it from the security? This is all so confusing.

    Do you have anything in writing that indicates she would release you from the lease early?
