    Question No Judgement Filed In Credit Card Lawsuit

    I was served a summons from a credit card company in Oct of 2006, I answered it in the allowed time, and I have not been contacted since. I called the clerks office today and they said that the case is still open, but no judgement has been sought. She said that they would probably win a summary judgement when they chose to file one, because it is my debt. My question is what are they waiting for, I feel like a sitting duck. I own nothing and my car is not mine yet, I still owe a ton on it. I thought I would get my day in front of the judge, but the clerk said that because I did not dispute the debt that they would attomatically win a judgement. If anyone has any advice I would love it.

    If you think this is not your debt, then file a motion to get your case heard.

    Otherwise, you need to pay your bills.
