    Default Deposit Refund

    Hello,
    I moved out of my apt after staying there for 1 1/2 years. I was never late on rent and had a good record. My security deposit was $850 but my landlord returned only $150. He also sent a letter along with it stating that he has deducted $650 because I had given him a late notice of moving out. I had informed him on 18th of Jan that I will be moving out by the end of this month. He was perfectly fine at that point of time. He never told me anything about his intentions of charging me for late notice at that time. Had he told me I would have stayed longer. The lease does state that I need to give a 1 month notice. But there is no mention of fines or anything.

    Can I do anything against his claim?

    I'm assuming you moved out Jan. 31st and gave notice on Jan. 18th. With that scenario, then yes the landlord is entitled to charge you either the full month of February or a pro-rated amount till Feb. 18th (depends on state law). Penalties for not give proper notice do not need to be specified in the lease as they are usually part of your local statutes.
