    Default Applying Greencard For My Parents

    I am applying the greencard for both my parents. I have several questions, and could anyone please help?

    1. In Form I-864 "Affidavit of Support", Part #6, Item #25 "Federal Income Tax Return Information", it looks it is optional to submit the photocopies of the Federal tax returns for my second and third most recent tax years. Could anyone please advise at what circumstance should I submit them so that it helps the application, versus only submitting the most recent year?

    2. In Form I-485 "Application for Register Permanent Residence or Adjust Status", Part 3 section "B", should my father check "yes" in the item "applying with you" when he fill in the information for my mother as his family number? My mother does apply at the same time, but she files a separate I-485.

    You submit documentation that would help support your claim that you can financially support your parents.

    Yes, when you identify a relative on the I-864 form who is applying with you, you check the box indicating that fact. The relative applying with you would do the same.

    I do have one more question regarding the procedure of their green card application. Since both my parents are currently on B2 (visitor) visa, which will expire in two months, May 2008. If I submit the application package (I-130, I-485, etc) in March, 2008, what should I do to keep it legal for their stay in U.S between the submission and getting the greencard, since most likely they won't get the green card before their B2 visa expire? Should I apply to extend their B2 visa?

    Hi:

    I am in the same situation ... my parents are here on B1 visa and their visa expiring in March... want to apply for their GC ..should I apply now when they are here in US or should they go back to their hoem country and apply then... they had their I 94 card stamped for 1 year ... so extending their visa beyound 1 yr seems impossible ... how did u do with ur parents since u had only 2 months until their B1 visa was expiring.... I heard that it is not good thing to apply for thier 485 while they are here On b1 visa as it shows dual intent ... B1=> non immigratn visa and 485 => intention to immigrate.. which may riase questons in interiew process.....

    Any input will be appreciated.

    I also want to do that in the future, I am not a citizen yet but in the process, I want to apply for my mother that came here in 1992, she came here with a visitor's visa and the visa was granted for 10 years but she had to go back within 6 months which she never did. So, I would like to sponsor her to get a greencard but she also wants to work, so I do not want to put her as my dependant, so she's actually here illegally now b/c everything expired...I have no idea how to go about getting her the right documentation for sponsoring her to get her legal immigration status, any help will be appreicated as well!
