I am a 25 year old in the state of Kansas, who is serving a 12-month probationary period for a third offense DUI. The term was enacted after serving a mandated 90-day jail sentence, along with a 45-day impatient treatment program. After completion, in the third month of probation, I was subjected to a random u.a., this was positive for thc. After which, I again served 2 months in county custody. (198 days total)
My probation was then again reinstated, the term being renewed for the original year. My second violation is less sever, it is due to not making enough after-care meetings. I have attended only 4 to 5 in the 4 months since my reinstatement.
My question is this: What could my underlying sentence be for this second violation? My max. sentence (I believe) was a year term. in jail. Second, If I have made a significant payment toward my fines, with decent representation, could I avoid another jail term? And, third, yet most important: I made not enough appointments due to the fact that I have actually moved out of state, I am working full-time in Oklahoma, without a license, my boyfriend and I would drive two hours every-other week to attend. What can I do to have my probation reinstated here, (Oklahoma) when it is a felony DUI?
There is a warrant out for my arrest, and I will not turn myself in, until I have adequate knowledge of what I face, and adequate representation to face the court.
