Arizona. I filed for Chapter 13 in January of this year. It was dismissed in the beginning of February, due to lacking paperwork and filing fee needing to be paid in full. This had been done, but it was not documented by the clerk before a motion to dismiss was filed. I was notified, and filed a motion to reinstate, stating within that the issues prompting the dismissal were satisfied, and the court did reinstate the case. I was in foreclosure, which was the reason for the Chapter 13, and the mortgage company trustee sold my home back to the lender, six days after the reinstatement of the case. I notified the lender, by phone, and sent the faxed copy of the reinstatement order to the fax number I was given by the person I talked to. I kept the fax confimation sheet, and also called this person back to insure he received the faxed copy. He stated he had received it, and would forward to the proper parties.
NOw, it seems, that this information was not given to the proper department, and did not know this until a man appeared at my door, saying the bank had sent him, and when was I moving out. The person I talked to at this company, as all people I have ever spoken to at this company, did not speak English very well, but reacted as though everything was being understood. Now, I have no idea who to go to. I tried calling the mortgage company, but again, get people I cannot understand, and I really don't believe they understand me. I have left several messages with the trustee who sold the home, but not once have I ever gotten a return call. This information was also faxed to them, as well as the information of the reinstatement of the case left on their answering system, but I have never been able to personally connect with anyone there.
Is there anything I can do at this point? Is it possible when the mortgage company realizes the circumstances, they will do something about it? The man who came to my door said he would call me after he does some research, and let me know what he discovers. I am hoping he can give me the number of someone who speaks and understands English, or a solid number for their trustee. Am I at a dead end here? I did everything I could to alert them to the fact of the reinstatement.
Does the trustee, or the mortgage holder have no responsibility to make sure a case is not active before the actual sale? Also, I believe they have no duty to let me know the sale has been reactivated, is that correct? As far as I knew, the final note I had from them was that the sale was postponed due to the filing of the Chapter 13.
