    Default Past Statute Of Limitations In Georgia - Now What?

    I have a medical collection showing up on my credit report for when my daughter got sick. The date of first delinquency is 02/2003. The last payment date is 04/03/2004. The total balance is only $171. Of course I would just pay it if they would just delete it from my credit report. But of course they won't. Regarding the statute of limitations in Georgia, for a medical collection what can they do to me at this point if I don't pay it?

    I presume you are considering this debt under an oral contract. I suspect a written contract would be applicable which has an SoL of 6 years in Georgia. Even if it is an oral contract, I believe the SoL still has not run as it is 4 years and that is not up yet. I have not researched it but typically a payment resets the time line. Some states do not but I beliebve they are in the minority.

    So, what can they do?

    I agree with jk that medical bills are considered written contracts with a 6 yr. SOL in Ga.

    It is possible if you don't pay it, they will sue you & get a judgment against you.
