    Default Legally Parked Car Towed Twice Now

    I live in Northern Virginia in a condo complex that requires residents to have aparking decal, which I do. A few weeks ago I discovered my car had been towed. The towing company insisted that I didn't have a decal. I asked to see my car and sure enough, there was my decal, clearly visible, even though it's in the tinted part of my windshield. I was able to get my car back for free. Tonight I discovered my car had again been towed. I called the company and camly explained that this is the second time my car had been towed and I have a decal. The lady put me on hold and came back and said that I did have a decal but it was hard to see. To make a long story short, she informed me that even though I have a decal, I was going to have to pay to get my car back. I informed her that that is ridiculous since I am not in the wrong. She said they don't have 20 minutes to look at a car to see if a decal is somewhere on it. She also said that they have a contract with the management company at my condo that said it had to be visible. I also have a paper (bylaws?) that never states where on the car the decal must be displayed. What makes no sense is that this towing company comes here at least once a week. Obviously someone has been doing their job and properly looking at my car, therefore seeing the decal, leading to why it hasn't been towed any other night. What are the actions I can take here? I don't feel I should have to pay to get my car back when it was 100% legally parked.

    I'd start by calling again and asking 'the lady' to put her supervisor on the phone. Keep going up their chain of command until you can get thru to someone with the authority to release your car free of charge. Be sure to keep telling them that the LAST time they made this mistake you were given your car back without paying. Talk to your condo's management company - have THEM contact the towing company to have your car release for free. I'd also make a formal written complaint to your HoA regarding the situation and ask that the location of the decal have some uniform guidelines so this does not happen a third time or to your neighbors. Depending on the rudeness and lack of cooperation you get from the towing company you might also consider asking the HoA to find a new service provider.
