    Default Statute Of Limitations For Sex Offenders In Florida

    My daughter was 17, boy was 25, resulted in a baby girl. Bio dad is registered sex offender. Daughter is now 19. Is it too late to press charges against the pervert who in my opinion took advantage of my daughter, as he was 25 at the time and lied and told my kid he was 18. Bio dad now fighting for custody of baby, which has lived with me (paternal grandmother) since birth.

    PS, was not aware of all the circumstances until after baby was born and went to get daycare assistance. The state makes you go thru child support. Way bad of mistake. Had I known, I would have worked three jobs to prevent him from having anything too do with the baby.

    Here in Georgia... there was a case very similar except the mother was the older of the two.

    And the judge did the math and had her arrested on the spot.

    Me, I would let it go to cutody trial. Tell the judge the circumstances. Write back and let us know what happened.

    Unlawful sexual activity with certain minors if someone age 24 or older engages in sexual activity with someone age 16 or 17.
    Up to 15 years in prison

    And if he was already a registered sex offender at the time he impregnated your daughter, he's likely to GET the max (plus additional charges).

    All of the above is, of course, true.

    I was just looking forward to the look on the sex offender's face when he walked into court demanding custody and realized he would end the day behind bars.

    Of course, I am a romantic.

    You might want to talk to an attorney; it will cost a few thousand dollars to get this put behind you. Your attorney may show the rapist or the rapist's attorney that it is not in the rapist's best interest to pursue this, lest he becomes the one raped.

    He can let it go to court and sh!t a brick when you and your attorney note that the child is the fruit of a statutory rape between a 25 year old RSO and a 17 year old girl. My guess is that sometime shortly after that he will be having more sex than he knows what to do with; NO ONE likes a Chester Chester Child Molester. (Sorry to any guy named Chet or Chester, except for the Chet turned into a turd by Kelly LeBrock in Weird Science).

    The courts are, unfortunately, used to seeing this on occasion. They know how to handle it. Your daughter, messed up or not, will need to testify. This might cause a headache in the custody of the child as you take care of him/her and your daughter does not. Either way, the courts will be hesitant to award him even supervised visitation of the child.

    You have quite a few years to nail him, may as well get it out of the way now.
