    Unhappy Criminal Employment Background Check Came Back Positive

    Hi, currently I am applying for a security license in NY. However, the criminal background check came back with 3 accounts of misdemeanors of mines dated back in 2002 on accounts of battery on person and vandalism. One of the charges I pleaded nolo contendere. I am still waiting for the final decisions from the licensing service in Albany, NY. I wanted to know if the licensing service in Albany, NY has the right to refuse to grant me the security license and if so under what circumstances and how could I stop that from happening? Is there anything I can do to help improve my chances on obtaining the license because it is really important to me that I get it. When the charges were upon me, I was still young, foolish and naive. Now, I am more mature and considering my future. I have other jobs in the security field even after the arrests but no criminal background check and other job in other fields as well. Can I have my employer in my previous job to write recommendations to the licensing service in Albany, NY to prove to them how much I have changed.

    I assume you are talking about jobs such as a security guard, etc. & not a job in securities (securities/stocks/bonds).

    New York State Governor George E. Pataki has signed legislation requiring a Federal background check on all individuals who apply for a security guard license in the State (Assembly Bill 8650 -- A). The measure, signed November 16, 2004 and effective May 15, 2005, requires that the applicants' fingerprints be submitted to the Federal Bureau of Investigation for a national criminal history check within five business days of receipt of the application. The process will allow authorities to determine whether or not the applicant for the security guard license has been charged with or convicted of a serious offense.
    Pursuant to State regulations, any individual who has been convicted of a serious offense may be denied a security guard license.

    A "security" job would be one where they would be very concerned about your background hx as would one also in the "securities" industry (stocks/bonds).

    Just what type of job in the security field (if not a sec. guard) are you applying for, duties, etc.

    I am applying for security guard license as in security officer for homeland security and not in regards to securities in stocks/bonds.

    When mentioned any individual who has been convicted of a serious offense may be denied a security guard license. Would 2 charges of a misdemeanor for battery on a person and vandalism be consider as a serious offense. I was served 30 days in county jail and paid a bond in the amount of $4,000. However, the charges were dated back in 2002, which was 6 years ago when I was 19 and at the same time I was residing in California and not in New York. The arrests and charges were made in California and now I reside in NY, but the national criminal background check came back with the arrests and charges of mine from when I was 19 in California, San Mateo.

    The charges of mine were PC 245 misdemeanor (A) (1) , PC 594 (B) (1) and last one is PC 242 Plea Nolo Contendere. Would these charges affect the chances of me getting the license and would these charges be consider as serious offense?

    I can't really say what your chances are of getting the license since that will be up to the licensing service. However, there is certainly a possibility that your hx will hinder your chances.

    They don't really define serious offense. They will I'm sure consider each application on an individual basis. Here is a link with some info re a security lic. in NY state:

    I would really like to know if you got your license. I know this is an old post, but I'm in a similar situation with the NY Guard Licensing agency in Albany with misdemeanor weed charges from 8 years ago in Texas.
