    Default Eleven Year-Old Assault Victim

    My son is 11 years old and in the 6th grade. He along with a friend that has mental issues, went to an after school party for a band teacher's going away party. The party was to last till 5:30 but at 5:12 my son was told to leave the building along with everyone else with no adult supervision. My so and the other boy walked away to another part of the school and where playing around when my son was acting like he was going to throw a stick at his friend, well the stick slipped and hit the kid in the backpack then head. At this time the other boy picked up another stick and hit my son several times then dropped the stick and pulled out a pocket knife and went after my son with it. There was another kid there that witnessed this as he stepped in between the boy and my son and used his cornet case to hold him back until he calmed down. I arrived at the school at 5:31 to pick up my son and found the doors to the party place locked as I was turning away the old band director and 2 unknown women exited the building. I asked them where my son was and was told, "He's not out here?" I said ah "No" I then found them and was then informed by my son of the incident. I asked the other child why he did it and then told him (calmly) he should not have pulled the knife on my son and then told my son to get in the truck and we left. I am told we can press aggravated assault charges on this child but then we where also informed that if we do the other child’s parents are going to file charges on our son. As of now the school is bending over backwards to take care of the problem and say they are trying to get the other child moved out of this school. I am afraid the other parents are going to file charges and then it will be too late for us or we will be on the defense. I really just want to protect my son! Any advise?     You are afraid that if you make a police report about the knife, your son may be prosecuted for hitting the other boy in the head with a stick? That's possible.

    Your son is going to be held accoutable for his actions based on the school systems violence policies. If there is a zero tolerance, your son will have to face punishment for his part of the incident. The punishment may not be as severe as the kid with the knife but he will be punished for his part (most likely suspension) so it's your call.
