    Default Breaking A Lease When There Is No Provision In The Lease

    Hello,

    I am in month 7 of a 12 month lease in Philadlelphia, PA. I wish to break the lease because I have moved elsewhere for a job. The lease, however, does not contain any provision that stipulates if or how I can break the lease. The landlord refuses to allow me to break the lease. What are my options?

    You can offer to find a suitable replacement tenant to take over the lease. The landlord isn't obligated to accept, but he may be more amenable to it if you make it clear that you don't want to just run out on your contractual obligation.

    Then, of course, you'll need to make the effort and find someone. Your landlord is under no obligation to let you out of the lease.

    There is no provision in the lease because you are expected to forfill it's terms. Not all leases have a termination clause.
