    Default Means Testing and Bankruptcy

    If I make less the the state median income, as perscribed in the "Means Test" does that mean I HAVe to go cH 7 instead of cH 13?

    I have some free cash (No more then $200-$300 a month. but of course, that may change due to employment

    Default Means Testing & Bankruptcy

    You can opt for Chapter 13 bankruptcy no matter what your income is. The primary purpose of means testing is to limit people from choosing Chapter 7 bankruptcy - they want more people to file under Chapter 13, which is more advantageous to creditors.
