    My friend a wile back stole something from another store and she pleaded not guilty. month later her trial was and Sears showed up with a video tape of her doing it and a copy of a confession she did while being confronted in the lost prevention room. her sentence did include 5 days in jail and fines plus community service. I would advise your friend to plead guilty to get it over with.
    Courts vary from state to state and diversion programs do also. If you want to advise someone to plead guilty that's fine, but make sure that you let them know they will have a criminal record. This could affect their life in the future. I guess it comes down to wanting a criminal record or not. I for one would never advise anyone to do anything that would result in this. A local attorney is best for a shoplifting case as they know the judges/programs better.

    Every case is different with different players. Sears is known to be one of the toughest stores to "work" with. I've also heard horror stories of them showing up in bankruptcy court and causing grief to people filing for bankruptcy.

    Sounds like the judge found you to be remorseful, you are very lucky. Good luck to you.

    Actually OP is very very lucky. They are taking two incidents and lumping them into one charge! Thats odd and may save OP and his desire to seek Diversion. If the charges had remained seperate Diversion could be of table, OP could get violation of second offense thus lose Diversion. OP is is also lucky as in some states multiple thefts from seperate locations could mean burgalry charge and a felony at that
