why did he give you a retrial? like what's the purpose of doing that if you said you were guilty the first time? did the the lp from jcp tell you you might go to jail you taking the item?

It sounds like your friend that pleaded "Not Guilty" and chose to fight it did so without the help of an experienced attorney, correct?
Note - I am not an attorney. I actually come from the loss prevention and criminal justice side of the house.
5 days in jail is a pretty harsh sentence for a first time offender.
i just got off the phone with the PD. She said something about an ARD program and that the judge will explain it to me at court. is anyone familiar with those? she also said i did not need an attorney...

I was just caught shoplifting. If they have the prove i did it and gave them back the stuff i stole. The right answer would be to......plead guilty RIGHT?
But if you plead guilty will you go to jail or just have it on your record?

yes definitely don't confess to stealing anymore DVD's. i quit my last job about 3 months ago but had stolen a lot of stuff from there. there are no cameras in the store and supposedly the only reason i was caught was because another employee called the work shoplifting hotline on my good friend whom i've perviously stolen things with. there was no proof of me stealing but they just brought me in for questioning and i stupidly confessed to everything because i thought they knew and now i'm screwed basically.

i never worked for jcpenney's. i had stolen this stuff from the place where i worked before i got caught at jcp but didn't actually get in trouble for it til after getting caught at jcp. but both cases are combined now into a one offense.
Explain how a prior theft from another retailer and your theft from JCP are combined?
at the time i was caught at the store where i worked, i hadn't gone to court for the jcp incident yet so it wasn't showing up on my record i'm assuming? i don't know for sure but the police officer had to put down this was my first offense because nothing show up in the system for jcp. so i just got my court date moved and the cost of the two items as one misdemeanor...as far as i know. i have one court date for both instances.
