    Default Residency Requirements Not Met

    My husband has been missing for 2 1/2 years and supposedly has surfaced in Bartlesville. He filed a petition to divorce on December 19, 2007. I had a volunteer PI look into the case, this PI is also a police officer and an officer of the courts in Oklahoma. There is no record of my husband ever having lived in Oklahoma. How easy is it to file a motion with the courts disqualifying this petition since it appears state and possibly county residency requirements have not been met?

    You would need to answer the petition using as defenses no jurisdiction and no venue. The OK court website may have some forms and information that would be of help. Be sure to send everything to the court CRRR and properly copy his attorney.

    Is there any marital property, custody or alimony issues? If not, you may want to go ahead with the OK divorce. You can also start your own case and then ask the OK court to dismiss if the court in your state would be a more convenient forum.
