    Default Possession Of THC

    Hello all,

    Three months ago I was sentenced to 12 months probation with the possibility of early discharge at 6 to 9 months. This is in the state of Wisconsin. I was caught with marijuana when I was 17 and the judge ruled it a small misdemeanor offense as I only have to see my probation officer once every three months. If this is completed, it will also be expunged from my record. So my question, it's been around 3 months and 6 months is coming around soon. My probation officer the first day said that isn't an option because I only see him once every 3 months, which goes completely against what the judge said. As far as doing what the court ordered (drug councelling, staying clean, paying all fees on time, getting a job within my PO's time frame, and obviously keeping out of trouble) I have done them all and plan to the whole time. Would it be a possibility or a fighting chance to get my attorney and try to petition to the judge for early discharge? They said I obviously need to "prove" myself to get expungement, but at this point I don't even care if it doesn't get expunged. I literally have nightmares of going to jail 3 out of the 7 days in a week; I know many people are thinking yeah well you deserve it you are a "criminal" but I don't see myself as one I guess it just varies to each persons education on marijuana and their standpoint. Since weed is illegal and is going to be for a long while I am just going to stay away from it because it's not worth prison the next time around. So anyway, would I be able to go to court and try and end this at 6 months if my probation officer is still against it even if I offer to cancel the whole expungement thing (I know it'll be on my record for life then, but I am willing to do it) or would I be able to do community service instead of probation or even possibly what I've been researching a bit; "unsupervised" probation or whatever it is that just allows you to not have to report to anybody as long as I don't get in any more trouble for the rest of the duration? I'm 18, I'm about to graduate with my HSED and plan to go back to school and I just want to move on with my life. Some may understand, but one violation consists of even being around people that smoke marijuana or drink or whatever. But that's what my friends do because, well, that's just what a lot of teenagers do, but I am not even allowed to be by my friends which I know some think well you should get new friends and your friends are stupid, but it's just not as easy as that, hopefully many understand. So could I do an alternative after my 6 month period, and what should I do? I respect you people here as you are very smart when it comes to law and you are willing to spread your knowledge which isn't always easy to get because there are many money-thirsty attorneys out there. (No offense to the ones on here obviously you aren't classified under that.)

    Why?

    Jay, I understand you're impatient to have done with this, but two things:

    1) The judge said 6 to 9 months. That doesn't mean you're guaranteed to be done in 6 months.

    2) A criminal record makes it difficult to find suitable employment. Being willing to forgo the expungement is short-sighted and potentially detrimental to your future.

    You may not think a misdemeanor drug charge is a big deal. Many employers would disagree. Why shoot yourself in the foot?

    Don't be so impatient. Finish up your probation, get the expungement, and keep your nose clean in the future.

    But as little as just being with my friends is enough to go to jail, and chances are it'd just stay on my record anyway if I did anything wrong so I'd just rather not go to jail and have it on my record than go to jail and still have it on my record. Would you even deem that a possibility if I took that to court at 6 months if they didn't want to directly let me off on discharge and I offered that? Or any of my other alternative ideas?
