    Default Son Has My Maiden Name

    It was an on and off thing. I had had enough. A month later, I realized I was pregnant. He denied it was his!
    When my son was 3 months old, I started seeing a long time friend. We've been married now for almost 12 years. He has raised my son as his father all this time. I did recieve 1 child support check in 15 yrs. (about 13 yrs ago) He never had visitation, or seemed to want it. I have no idea where my son's biological father is. My son has my maiden name, but we would like to change his last name to my and my husband's name. Unfortunately, we don't have alot of money, or this would've been done years ago. My son has expresses his desire to change his name. He knows my husband is not his father, but he knows who loves him!
    do we still need to locate his biological father? Does he still have a say?

    We now live in nc.

    Was paternity ever established legally?

    I did put his name on the birth certificate.. I refused to put unknown.
    Also, I'm guessing he signed the paternity papers for the state for the child support. I was on state assistance then.

    You put dad on the birth certificate so at this juncture it follows that you get to notify him of your name change petition, and he gets the opportunity to object. I doubt a judge would take him very seriously if he did so, given his abandonment of the child.

    If you explain how you added him without his knowledge or consent, or how you got a child support check without establishing paternity, that may lead to additional information.

    Apparently in the state of PA, I didn't need his signature or his ok. I was alone when I delivered my son. I refused to put unknown on the paperwork for the birth certificate, so I put his father's name. I also didn't know that both names would go on the birth certificate. That's how the father's name is on it.

    As far as child support.. I was on state assistance. They ask for any info you have on the father and they then search for him. They then contacted him. I believe what happenes next is that they have the father sign a paper stating paternity. My guess is that he knew the truth so he signed it and bingo, I got a check. It was through Domestic Relations. I never had contact with him myself. To this day I still haven't.

    Paternity has been legally established, so you will need the legal father's consent. Get a consult with a local attorney because it is probably possible to give notice by publication if you don't know where the father is.
