    Default Defendant Was Charged Even Though The Victim Dropped The Charges

    What is the name of your state? NY: Rockland County

    My friend was arrested due to breaking a window at a party.

    The woman called the cops but did not want him arrested.
    She didn't want him charged for anything, but he's being charged anyway even though she called the officer and said she didnt want him charged.
    Bail wasn't "met". (What does it mean for a bail not to be met? Under what circumstance can that happen exactly?)
    Is it ok for them to just not drop the charges when there wasnt any intention of him being charged or even arrested in the first place?

    And they're counting it as a felony. Is there anything the woman could do? The damages for the window is practically paid for already, but I don't think its going to work with just a check from friends, legally..

    The police can legally charge somebody without the victims consent. If people don't want to have somebody arrested then they shouldn't call the cops in the first place!

    we're thinking about going to the District Attorney tomorrow morning to see what our options are..if any. Is that a wise idea? or does anyone have any better idea or advice?
