    Default Legal Consent In Florida

    Im a 25 year old male and have been having sex with a 17 year old female for sometime now. Her parent knew about us and what we where doing and said nothing about ther disapproval or letting it known. This female will be 18 in 3 days but went to court today on a "v.o.p" charge and her mother said she was going to press charges on me. She will be on probation untill may of this year. Because of the time untill her birthday and the fact that she is still on probation can i be in trouble with the law?

    Your already in trouble AOC in FL is 18. You want advice stay away from this child until she turns 18. FL has some of the toughest laws whenit comes to adult minor relationships. Unless a few years (for each act) in Prison and lifetime registration as Sex Offender sound good stay away and hope charges are not pressed

    794.05 Unlawful sexual activity with certain minors.--
    (1) A person 24 years of age or older who engages in sexual activity with a person 16 or 17 years of age commits a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084. As used in this section, "sexual activity" means oral, anal, or vaginal penetration by, or union with, the sexual organ of another; however, sexual activity does not include an act done for a bona fide medical purpose.
    (2) The provisions of this section do not apply to a person 16 or 17 years of age who has had the disabilities of nonage removed under chapter 743.
    (3) The victim's prior sexual conduct is not a relevant issue in a prosecution under this section. (4) If an offense under this section directly results in the victim giving birth to a child, paternity of that child shall be established as described in chapter 742. If it is determined that the offender is the father of the child, the offender must pay child support pursuant to the child support guidelines described in chapter 61.
    Even if her parents handed you the box of condoms and high fived you on the way out, the sexual activity was and is illegal. Get an atty. You are looking at the possibility of up to 15 years in prison, up to a $10,000 fine and registration as a sex offender.

    The only way out of it was if you weren't having sex of any type (oral included). You can't lie in court, she can't lie in court. If her mom presses charges you are looking at a very painful 2-5 years (average; 15 is the max, IIRC) and the rest of your life is shot.

    On the plus side, if the parents knew about it they may be charged as well depending on their knowledge and on their influence.
